CHRISTIAN COUNTY PROSECUTING ATTORNEY’S OFFICE SUPPORTS A CAUSE

On Friday March 31, 2017, the Christian County Prosecuting Attorney’s Office played BUNCO for a Cause. The CCPA Office competed in the Christian County Sertoma Club BUNCO night. Amy Dent, Legal Assistant; Suzanne Frakes, Legal Assistant; Julie Harlan, Victim Advocate; and Amy Zacek-Smith, Investigator rolled the dice to benefit Least of These Food Pantry, Freedom’s Rest Domestic Violence Shelter and Care to Learn Ozark & Nixa.

JAMES DYLAN MCGINNIS PLEADS GUILTY TO SPARTA PD BURGLARY

OZARK, MO – The Christian County Prosecuting Attorney’s Office announces that on March 31, 2017, James Dylan McGinnis, dob: 04/19/1991, pleaded guilty in front of the Honorable Eric Eighmy.

McGinnis pleaded guilty to the class B felony of first-degree burglary and three counts of the class C felony of receiving stolen property for an event that occurred on February 19, 2016.

On February 19, 2016, Deputies were dispatched to Sparta Police Department.  It was determined that items were stolen from the Police Department, including two AR-15s, a shotgun, a large quantity of ammunition, several uniforms, bullet proof vests, a laptop computer, and other electronic items.  The total value of the stolen items was estimated at over $10,000.

Deputies gathered information from several individuals who stated that there were two individuals that committed the burglary of the Sparta Police Department.  McGinnis was the individual identified as the person that went inside the building.

Pursuant to a plea agreement, McGinnis received a maximum sentence of 15 years in the Missouri Department of Corrections on the first-degree burglary.  He received sentences of seven (7) years on the receiving stolen property counts.  All sentences to run concurrent to each other.

In addition, pursuant to the plea agreement, McGinnis was ordered to pay $13,881.24 in restitution to the City of Sparta.

The range of punishment for a class B felony is five (5) to fifteen (15) years incarceration. The range of punishment for a class C felony is one day up to seven (7) years incarceration and/or a fine not to exceed $5000.

The case was prosecuted by Senior Assistant Prosecuting Attorney Anna Bunch. The case was investigated by the Christian County Sheriff’s Department, and the lead detective was David Loe.

CHRISTIAN COUNTY PROSECUTOR OFFICE 2016 ANNUAL REPORT

Christian County Prosecuting Attorney, Amy J. Fite presented the 2016 Annual Report to members of the Christian County Commission on December 30, 2016. Missouri Law requires that an annual report be prepared and filed with the County Commission once a year.

DUSTIN GUERIN SENTENCED TO 30 YEARS MISSOURI DEPARTMENT OF CORRECTIONS FOR APRIL 2015 SEXUAL ASSAULT

OZARK, MO – The Christian County Prosecuting Attorney’s Office announces that on January 30, 2017, Dustin Guerin 08-01-1982, was sentenced to a total of 30 years in the Missouri Department of Corrections for events occurring on April 25, 2015.  The Honorable Judge Jennifer Growcock imposed a sentence of 25 years following Defendant’s guilty pleas to two counts of rape in the first degree, one county of sodomy in the first degree, and one count of attempted sodomy in the first degree.  Defendant was sentenced to 5 years following his guilty pleas to the crimes of sexual exploitation of a minor, assault in the first degree, armed criminal action, and abuse of a child.  The sentences for rape in the first degree, sodomy in the first degree, and attempted sodomy in the first degree will run concurrently with each other, but consecutively to the remaining sentences. The sentence imposed for sexual exploitation of a child, assault in the first degree, armed criminal action, and abuse of a child will run concurrently with each other and consecutively to the offenses of rape in the first degree, sodomy in the first degree, and attempted sodomy in the first degree.  Defendant received a sentence totaling 30 years in the Missouri Department of Corrections pursuant to a plea agreement reached with the State of Missouri.

Rape in the first degree, sodomy in the first degree, attempted sodomy in the first degree, and assault in the first degree require 85% of Defendant’s sentence be served before Guerin is eligible for probation and parole.

The case was prosecuted by Christian County Assistant Prosecuting Attorney Kristen M. Tuohy.  The Christian County Sheriff’s Department investigated the crime.

Dustin Birch joined the Christian County Prosecutor’s Office in December of 2016.  Dustin received his undergraduate degree Western Illinois University in Macomb, IL with a Bachelor’s Degree in Law Enforcement and Justice Administration. Dustin received his Juris Doctor from Arizona Summit Law School in Phoenix, AZ.
