Christian County Prosecuting Attorney, Amy J. Fite announced today that ROCKY D CLARY, dob: 10/14/1961 of Kirbyville, Missouri was sentenced on Friday September 9, 2011, by the Honorable Mark Orr, to ten (10) years in the Missouri Department of Corrections for the class B felony of Driving While Intoxicated as a chronic offender. Probation was denied.

During the evening hours of November 30, 2009, ROCKY D CLARY operated a motor vehicle on US Highway 65 south of State Highway F while under the influence of alcohol. A City of Ozark police officer made contact with ROCKY D CLARY while he was behind the wheel of his motor vehicle. The officer noticed CLARY had a strong odor of intoxicants coming from his breath, was swaying visibly, and that his speech was slurred and filled with profanity. CLARY then refused to submit to any standardized field sobriety tests. After he was arrested and transported to the Christian County Jail, ROCKY D. CLARY refused to submit to a chemical sample of his breath, blood, or urine. Court records showed ROCKY D. CLARY had four (4) prior alcohol related convictions.

The range of punishment for the class B felony of Driving While Intoxicated as chronic offender is five (5) to fifteen (15) years in the Missouri Department of Corrections.
